Interview with Steve Bliss, Moreno Valley Probate Attorney

Reporting by Brenda Flores

Today, we’re speaking with Steve Bliss, a respected probate attorney serving the Moreno Valley community. Steve, thank you for taking the time to discuss the complex world of estate planning with us.

Providing Notice: A Crucial Step in Probate

Steve, can you walk us through one of the key steps in the probate process? What are some of the challenges involved?

Certainly, Brenda. One crucial step is providing notice to all interested parties. This involves publishing a notice in a local newspaper three times, mailing notices to heirs and beneficiaries identified in the will or through intestate succession laws, and notifying known creditors using a specific form (Form DE-157).

The purpose of this step is multifold. Firstly, it ensures transparency by making the probate proceedings public knowledge. Consequently, anyone with a legitimate claim to the estate has an opportunity to come forward. Secondly, providing notice protects the executor or administrator from potential liability down the line. They can demonstrate that they took reasonable steps to locate and inform all interested parties.

Nevertheless, this step can sometimes be challenging. Locating heirs who may have moved or lost touch can be a time-consuming process. Moreover, ensuring that all creditors are identified and notified can be difficult, especially in cases involving complex business dealings.

I recall one instance where we were trying to locate an heir who had been estranged from the family for decades. After extensive genealogical research, we finally tracked him down living in a different state. It turned out he was unaware of his inheritance and deeply grateful to be found. This experience underscored the importance of diligent effort in this stage.

According to a study by the American Bar Association, approximately 20% of probate cases encounter delays due to difficulties in locating heirs or creditors. This highlights the significance of working with an experienced probate attorney who has the resources and knowledge to navigate these complexities effectively.

Steve, what advice would you give to individuals considering probate?
