Ted leans forward, “This step is crucial. As executor or administrator of the estate, you have a responsibility to identify and pay all valid creditor claims. This can involve reviewing bills, contacting creditors, and negotiating settlements if needed.” He pauses, then adds:
- “It’s important to remember that probate court oversees this process, so everything must be documented and transparent.”
- “You’ll also need to file and pay any applicable federal and state taxes on behalf of the estate. This could include income tax returns for the deceased or estate tax returns depending on the size of the estate.”
“One situation that sticks with me involved a client whose loved one had accumulated a significant amount of credit card debt,” Ted recalls thoughtfully. “We were able to negotiate settlements with the creditors, which ultimately saved the estate a considerable sum of money and allowed for a more equitable distribution among the beneficiaries.”

“Absolutely,” Ted says with a knowing smile. “There was one case where we discovered an unpaid loan that the deceased had taken out from a family member. This created some tension among the heirs, as they weren’t aware of the loan and felt it shouldn’t be considered a valid debt.” He continues,
“We navigated this situation carefully by reviewing all available documentation and facilitating open communication between the parties involved. Ultimately, we reached a compromise that satisfied everyone and ensured the estate was handled fairly.”
