Hello everyone and welcome back to the show. Today we’re talking about something that can be a little intimidating for some folks: estate planning. To help us navigate this important topic, I’m joined by Ted Cook, an estate planning attorney based right here in sunny San Diego.
What sparked your passion for Estate Planning?
“You know, it’s funny,” Ted says with a chuckle. “Most people think of estate planning as something you do when you’re older. But the truth is, life can be unpredictable. I started my career focusing on family law and saw firsthand how crucial it was for people to have a plan in place – no matter their age.
“Helping individuals and families protect what they’ve worked so hard for and ensure their wishes are honored really resonated with me. It’s about providing peace of mind knowing that your loved ones will be taken care of.”
Let’s Talk About the Steps Involved in Estate Planning
Before we dive into specifics, could you walk us through the general process someone can expect when embarking on estate planning?

- Choose Key People to Carry Out Your Wishes
- Create Core Estate Planning Documents
- Fund the Trust (if Applicable)
- Communicate Your Plan
- Review and Update Your Plan Regularly
- Organize and Store Your Documents
Funding a Trust: The Essentials
For this interview, let’s focus on step E – Funding the Trust (if Applicable). Can you elaborate on why this step is crucial?
“Think of it like building a house,” Ted explains. “You’ve got the blueprints – your trust document – but it’s not a home until you furnish it. Funding your trust means transferring ownership of assets, like real estate, bank accounts, or investments into the trust’s name.
“This is essential because it allows those assets to bypass probate, a lengthy and often expensive legal process. It also ensures that your wishes for how those assets are distributed are followed. Without funding the trust, it essentially becomes an empty shell.”
“Funding a trust can seem daunting at first but Ted made the whole process so clear and straightforward. He even helped me coordinate with my financial advisor, which saved me a lot of time and stress.” – Sarah M., Point Loma
Have You Encountered Any Challenges With Funding Trusts?
“Oh, absolutely,” Ted replies with a knowing smile. “One case I remember involved a client who had inherited a valuable piece of artwork from their grandmother. They hadn’t updated their trust after the inheritance and assumed the artwork was automatically included. Unfortunately, that wasn’t the case.
“It took some legal maneuvering to get it added to the trust, which caused unnecessary delays and expense. That experience highlighted how crucial it is to be meticulous about funding a trust with all assets you intend to include.”
The Impact of Trust Funding
“My family had been talking about estate planning for years but never got around to it. Working with Ted, we finally felt confident enough to put everything in place. Knowing that our kids will be taken care of even if something happens to us is a huge relief.” – John and Susan D., La Jolla
“Ted has a real gift for explaining complex legal concepts in simple terms. He listened patiently to all my concerns and made sure I understood every step of the process.” – Maria L., Pacific Beach

About A Estate Planning:
Estate planning: is the process of arranging how your assets will be managed and distributed after your death or if you become incapacitated, ensuring your wishes are followed and minimizing potential issues for your loved ones.
Purpose: Estate planning helps you determine who will inherit your assets, how they will be managed, and how to minimize taxes and other potential complications.
Who Needs Estate Planning? Everyone, regardless of their age or net worth, should consider estate planning to ensure their wishes are carried out and to protect their loved ones.
What Is Estate Planning and Why It Matters:
In reality, almost everyone has an estate. Your estate includes everything you own—your car, home, other real estate, bank accounts, investments, life insurance policies, furniture, and personal belongings. Regardless of the size or value, if you own assets, you have an estate. And one universal truth applies: you can’t take any of it with you when you pass away.
When that time comes – and it’s a matter of when, not if – you’ll likely want to have a say in how your assets are distributed and to whom. Estate planning allows you to make those decisions in advance by creating clear, legally enforceable instructions about who should receive your property, what they should receive, and when they should receive it. Proper planning can also help minimize taxes, legal fees, and probate costs.
Estate planning is the process of arranging for the orderly transfer of your assets after death, with the goal of protecting your loved ones, preserving your legacy, and ensuring your final wishes are honored as efficiently and cost-effectively as possible.
