Reporter Introductions
Good evening, Wildomar and welcome back to our legal spotlight segment. My name is Sarah Thompson, and tonight we’re speaking with a local expert on trust law. Please join me in welcoming Steve Bliss from Wildomar Probate Law.
Steve Bliss Introduction
Steve, thank you for joining us tonight. You specialize in estate planning and probate matters, correct?
It’s my pleasure to be here, Sarah. Yes, I’ve been helping families in Wildomar and surrounding areas navigate the complexities of estate planning and probate law for many years.
Types of Trusts
Could you tell us a little bit about the different types of trusts available to individuals?
Certainly. There are numerous types of trusts, each serving specific purposes. For instance, Revocable Living Trusts are very common because they allow individuals to maintain control over their assets during their lifetime while avoiding probate after they pass away.
Conversely, Irrevocable Trusts offer greater asset protection but relinquish some control over the assets placed within them. Testamentary Trusts come into play only upon someone’s death and are often used for minor beneficiaries.
Focus on Asset Protection Trusts
Steve, could you elaborate on Asset Protection Trusts? They sound intriguing.
Asset Protection Trusts are designed to safeguard assets from potential creditors or lawsuits. Now, while California law offers limited protection in this regard, we can sometimes utilize trusts established in jurisdictions with stronger asset protection laws.
The process involves transferring assets into the trust, effectively removing them from your personal ownership. Consequently, these assets become shielded from claims by creditors.
Nevertheless, it’s crucial to understand that this strategy should be implemented proactively and with careful legal guidance. It’s not a solution for someone already facing litigation.
Moreover, the effectiveness of an Asset Protection Trust depends on various factors, including the specific state laws where the trust is established and the nature of the potential claims against you.
It’s important to remember that there are ethical considerations involved as well. We always ensure our clients understand the legal implications and ramifications before proceeding with any asset protection strategy.
Dealing with Issues
Have you ever encountered any challenges or unexpected issues when setting up Asset Protection Trusts?
Well, one situation I remember vividly involved a successful entrepreneur who was facing potential litigation from a disgruntled business partner. He came to me wanting to protect his assets immediately.
We discussed the Asset Protection Trust option but discovered that he had already transferred significant funds into personal accounts abroad in an attempt to shield them. Unfortunately, this hasty action could have been construed as fraudulent conveyance and ultimately weakened his position.
Ordinarily, we would have advised him on proper asset structuring within a trust framework before any potential claims arose. In the end, we were able to work with his legal team to mitigate some of the risks, but it highlighted the importance of early planning and transparency.
Statistics
About 1 in 3 Americans will face a lawsuit in their lifetime. (Source: U.S. Department of Justice) That underscores the need for proactive asset protection measures, especially for individuals with substantial assets or high-risk professions.
