“Certainly,” Steve says. “One crucial step is clearly naming your beneficiaries. This means specifying exactly who will inherit your assets and in what proportions. It might seem straightforward, but overlooking this detail can lead to unintended consequences and potentially lengthy legal battles.”
He continues, “Notwithstanding the emotional aspect, there are practical reasons for clear beneficiary designation. Ordinarily, if you pass away without clearly stating who inherits what, your assets will be distributed according to state intestacy laws. These laws might not align with your wishes and could result in unintended beneficiaries receiving portions of your estate.
“Moreover,” Steve adds, “naming contingent beneficiaries – individuals who inherit your assets if your primary beneficiary predeceases you – is essential for ensuring that your wishes are carried out even in unforeseen circumstances. I recall a case where a client hadn’t named a contingent beneficiary for their life insurance policy. When the primary beneficiary unexpectedly passed away, the insurance proceeds ended up going to the state because there was no alternative designation. It was a heartbreaking situation that could have been easily avoided.”
