Estate Planning with Steve Bliss

Good morning, Moreno Valley and welcome to ‘Legal Matters’. I’m Brenda Sanchez, and today we have the esteemed Steve Bliss, a prominent estate planning attorney serving our community here in Moreno Valley.

Understanding the Importance of Naming Beneficiaries

Steve, thank you so much for joining us. Let’s talk about naming beneficiaries – why is this step so crucial in estate planning?

Brenda, it’s a pleasure to be here. Naming beneficiaries is arguably one of the most vital steps in the entire estate planning process. You see, without clearly identifying who inherits your assets, things can get complicated, sometimes even contentious, after you pass away. Imagine a scenario where someone passes away without a will or designating specific beneficiaries – their assets would then be subject to intestacy laws, which dictate how property is distributed based on legal standing rather than personal wishes.

This can lead to unintended consequences, potentially leaving loved ones with less than intended or even creating conflict amongst family members. Consequently, clearly outlining who receives what ensures your final wishes are honored and minimizes the potential for disputes during an already difficult time.

Notwithstanding its importance, I often find that people underestimate the significance of updating beneficiary designations over time. Life changes – marriages, divorces, births, and even the passing of loved ones can all necessitate revisions to your beneficiary list. Regularly reviewing these designations, ideally every few years or after any major life event, is crucial to ensure your estate plan accurately reflects your current desires.

In fact, according to a recent survey by Caring.com, over 60% of Americans haven’t reviewed their beneficiary designations in the past five years. This highlights a concerning trend and underscores the need for ongoing vigilance when it comes to estate planning.

I recall a case where a client had named his brother as the sole beneficiary of his retirement account, but they had a falling out years later. Sadly, my client passed away without updating his beneficiary designation. This resulted in his estranged brother inheriting a significant sum, contrary to my client’s intentions. It was a heart-wrenching situation that could have been easily avoided with a simple update.
